Terms of Use

These terms of use ("Terms of Use") mandate the terms on which the users access and register on the 'DCamp Fitness' website, m-web and mobile application (collectively referred to as the "Platform"), operated by DCamp Foods & Health Services Private Limited ("Company", "we", "us", "our"). Please read these Terms of Use carefully before using or registering on the Platform. This document is an electronic record in terms of the Information Technology Act, 2000 and the rules thereunder, as applicable.

Applicability

These Terms of Use apply to all the users of the Platform, including:

  1. Any supplier of goods / services (an individual, professional, entity, or similar institution) on the Platform, directly or indirectly, including designated / authorised associates, employees, partners.
  2. An individual who accesses and registers on the Platform and/or places a service request on the Platform ("End-User", "You", "Your" or "Users").
  3. Otherwise a user or visitor of the Platform.

Platform Services

You acknowledge that the Platform is a web service that allows You to avail services / buy products directly from the Company as well as from various Partners. The services (collectively, the "Services") include:

  • Physical and mental fitness centre memberships / classes and allied services ("Fitness Services") provided by DCamp Foods & Health Services Private Limited and its franchisees.
  • Memberships granting access to fitness, diet, recreation and educational services from third-party fitness centres, gyms and studios.
  • Food items from DCamp Foods & Health Services India Private Limited.
  • Appointments with registered medical professionals for physical / in-person and tele-consultations and diagnostic services.
  • Purchase of pre-packaged / prepared / cooked food and beverage items sold by various restaurant partners.
  • Single-session / subscription based digital services (audio / video content, real-time training, coaching).
  • Purchase of educational materials, coursework, video and/or audio content related to fitness, nutrition and cookery.
  • Registration for recreational or professional events conducted by DCamp Foods & Health Services Pvt Ltd.

Fitness Services

  1. Fitness Services include offline mental and physical fitness, sports-related training activities (swimming, mindful yoga, psychotherapy, meditation, and related activities).
  2. To be eligible: (a) You have attained at least 18 years of age, and (b) You are competent to enter into a contract under applicable law.
  3. The Company disclaims any guarantees of exactness as to duration, type or satisfaction from Fitness Services facilities.
  4. Your booking of Fitness Services signifies acceptance of additional terms and conditions, guidelines and house rules of the relevant centre.
  5. Membership cannot be extended for any reason, including health reasons. Membership ends on the specified date irrespective of usage.

Fair Usage Policy

  • Under limited / select memberships, You can only book, access and attend classes at Your primary / home centre.
  • Under unlimited memberships, You may attend classes at centres other than Your primary, subject to restrictions at certain locations.
  • DCamp Fitness reserves the right to penalise or suspend memberships in case of misuse or missed cancellation windows.
  • Members may transfer to another city subject to the receipt of applicable price difference.
  • Members may transfer their membership to another individual (Transferee) subject to approval and applicable fees.

Fit-Kids

  1. Purchased and availed only by guardians for children between 5 and 14 years, subject to a signed guardian consent form.
  2. Fit-Kids classes are available only at select DCamp centres offering the programme.
  3. Non-transferable — misuse leads to immediate cancellation without refund.
  4. Cannot be extended for any reason, including health conditions.

Digital Services

DCamp Fitness facilitates pre-recorded / do-it-yourself audio and video content ("Digital Content Services") and real-time coaching / training sessions with third-party service providers ("Digital Training Services"). Digital Services memberships are subject to the payment of necessary fees. Any memberships / single sessions bought are non-refundable and cannot be extended; packages can be transferred subject to a transfer fee and taxes.

  1. You must ensure that You are physically and medically fit to participate in workout sessions.
  2. Session recording (audio / video) may be captured for quality and safety purposes.
  3. Cancellation and rescheduling are governed by the respective Partner's terms.

Acceptance of Terms of Use

  1. Use of and access to the Platform is offered upon the condition of acceptance of these Terms of Use, along with any amendments made by the Company at its sole discretion.
  2. The Company retains an unconditional right to modify or amend these Terms of Use without prior notice. It is Your responsibility to check periodically for changes.

Eligibility to Use

  1. The Platform Services are not available to persons under 18 or to Users suspended or removed by the Company.
  2. The Company may refuse access, or terminate existing access, at any time without according reasons.
  3. You may not have more than one active Account. You may not sell, trade or transfer Your Account or impersonate another User.

User Account, Password & Security

  1. You must register with accurate, complete and up-to-date information. Update Your Account promptly on any change.
  2. You are fully responsible for all activities that occur under Your Account.
  3. Use of another User's Account is expressly prohibited.

Fees, Charges & Subscriptions

  1. Free trials, when offered, run for the period specified at sign-up. Free trials may not be combined with certain other offers.
  2. You agree to pay all fees and charges. Additional taxes or third-party charges may apply.
  3. Non-recurring subscriptions are non-cancellable. Recurring subscriptions can be cancelled from Account Settings before the next renewal date.

Payment Services

  1. All payments for Platform Services are made to the Company through the Platform.
  2. You undertake to use a valid payment card, bank details, third-party wallet or other payment method with the authority to use them.
  3. The payment receipt is provided by the respective Vendor; the transaction summary is provided by the Company.
  4. Except as otherwise required by law, the Company is not liable for payments authorised using Your Payment Details.

Refund Policy

  1. Fitness Services — Any DCamp Fitness memberships / sessions / classes / activity bookings are non-refundable, non-exchangeable and non-saleable.
  2. DCamp Foods — You may request cancellation / pausing of Food Product orders and request refunds / adjustments in future orders; acceptance is subject to review.
  3. Digital Services — Cancellations must be initiated before the next renewal date to avoid billing.
  4. The Company may cease its relationship with You unilaterally without cause and issue applicable refunds where mandated.

Use of Platform

  1. Subject to compliance with these Terms, the Company grants a non-exclusive, revocable, limited privilege to access and use the Platform and the Platform Services.
  2. You must not access the Platform by any means other than through the interface provided. Scraping, deep-linking, robots and data-mining tools are prohibited.
  3. You acknowledge that content on the Platform may include material from third parties that You may consider offensive; the Company disclaims liability for such content.

Grievance

In case of any dissatisfaction with the Platform Services, please first file a formal complaint with our customer service at info@dcamp.co.in before pursuing any other recourse.
